Ex-legal assistant loses appeal


"The long delay before the Human Resources Minister referred a purported dismissal in 1998 to the Industrial Court caused a former legal assistant to lose her claim.
Both the High Court and Court of Appeal ruled that seven years and five months was an “inordinate” delay because the objective of the Industrial Relations (IR) Act was expeditious settlements of industrial disputes for industrial harmony"

"On July 1, 2009, High Court (Appellate and Special Powers) judge Justice Mohamad Ariff Md Yusoff said the Federal Territory/Selangor IR Department’s explanation that it did not have enough reconciliation officers between 1998 and 2000 to cater for the bigger workload with the increase in dismissal cases because of the economic slowdown was “not a reasonable explanation for the delay from the totality of the facts".
